General terms and conditions for gift cards
These general terms and conditions apply to the purchase and use of a New Yin & Yang gift card bought online.

Article 1. Definitions
- 1.1Entrepreneur: New Yin & Yang, established at Amsterdamsestraatweg 193, Utrecht.
- 1.2Buyer: the natural person who does not act for purposes relating to their trade, business, craft or profession and who buys a Gift Card from the Entrepreneur.
- 1.3Beneficiary: the person to whom the Buyer gives the Gift Card or to whom the Code has been sent.
- 1.4Gift Card: the voucher issued by the Entrepreneur, denominated in an amount in euros, which can be applied towards payment for treatments at the Entrepreneur.
- 1.5Code: the unique code of twelve (12) characters by which the Gift Card is redeemed.
- 1.6Booking Page: the online booking page of the Entrepreneur on which a Gift Card can be bought and redeemed.
- 1.7Agreement: the distance contract between the Entrepreneur and the Buyer for the purchase of a Gift Card.
- 1.8Cooling-off Period: the period of fourteen (14) days within which the Buyer may exercise the right of withdrawal.
- 1.9Day: calendar day.
Article 2. Identity of the Entrepreneur

Article 3. Applicability
- 3.1These general terms and conditions apply to every offer of the Entrepreneur and to every Agreement concluded via the Booking Page.
- 3.2Before the Agreement is concluded, the text of these general terms and conditions is made available to the Buyer by means of a hyperlink on the Booking Page. By ticking the box provided for that purpose, the Buyer declares to have taken note of these general terms and conditions and to agree to them.
- 3.3In addition, the booking terms of the Entrepreneur apply to the booking of, and payment for, treatments.
Article 4. Offer and amount
- 4.1A Gift Card is denominated in an amount of at least €35 and at most €2000. The Buyer chooses one of the amounts offered or enters another amount within these limits.
- 4.2The Gift Card can be redeemed solely for treatments at the Entrepreneur. The Gift Card cannot be exchanged for cash and any remaining balance will not be paid out.
Article 5. Conclusion of the Agreement and payment
- 5.1The Buyer pays exclusively by iDEAL, via the payment service provider Mollie.
- 5.2The Agreement is concluded only at the moment the payment has been received by the Entrepreneur and confirmed by the payment service provider. Until that moment no Gift Card is created.
- 5.3If the payment fails or expires, no Agreement is concluded, no Gift Card is created and no amount is charged.
- 5.4If the payment status is unclear, the Buyer must not pay again but should contact the Entrepreneur, so that the Entrepreneur can verify the details with the payment service provider.
Article 6. Provision of the Code
- 6.1After the Agreement has been concluded, the Code is sent by email to the Buyer and, if the Buyer has specified a Beneficiary, also to the Beneficiary.
- 6.2The Code remains visible on the confirmation page for twenty-four (24) hours after payment. Thereafter the Code is available only in the email sent.
- 6.3The Buyer is responsible for the accuracy of the email addresses provided.
Article 7. Use of the Gift Card
- 7.1The Gift Card is redeemed by entering the Code when booking a treatment online or by showing the Code in the salon.
- 7.2The Gift Card may be redeemed in several instalments. The part of the balance not redeemed remains available on the Gift Card until the end of the validity period.
- 7.3If the balance is lower than the price of the treatment, the Buyer or the Beneficiary pays the difference by iDEAL when booking online and on the spot when in the salon.
- 7.4The Gift Card cannot be redeemed for an appointment that has already been paid for in whole or in part.
Article 8. Validity period
- 8.1The Gift Card is valid for two (2) years, calculated from the day of purchase.
- 8.2After the validity period has expired, the remaining balance can no longer be redeemed and lapses.
Article 9. Right of withdrawal
- 9.1The Buyer may withdraw from the Agreement during the Cooling-off Period without giving any reason. The Cooling-off Period starts on the day after the Agreement was concluded.
- 9.2Withdrawal is possible only as long as the Gift Card has not been used, in whole or in part.
- 9.3The Buyer exercises the right of withdrawal by sending the Entrepreneur an unequivocal statement by email to newyinenyang@gmail.com before the end of the Cooling-off Period, stating the email address with which the Gift Card was bought. The Buyer may use the model form in the annex to these general terms and conditions for that purpose, but is not obliged to do so.
- 9.4The Cooling-off Period is observed if the statement is sent before the Cooling-off Period expires.
- 9.5After the Cooling-off Period has expired, withdrawal is no longer possible. The Gift Card then remains valid until the end of the validity period.
Article 10. Consequences of withdrawal
- 10.1The Entrepreneur confirms receipt of the statement of withdrawal.
- 10.2The Entrepreneur reimburses the amount paid by the Buyer without undue delay and in any event within fourteen (14) days of receipt of the statement of withdrawal, via the payment service provider Mollie and using the same payment method as the Buyer used. The time at which the amount is credited also depends on the payment service provider and the Buyer’s bank.
- 10.3Upon withdrawal the Gift Card becomes invalid. No costs are charged for the withdrawal.
Article 11. Loss, theft and unauthorised use
- 11.1Whoever has the Code can redeem the Gift Card. The Buyer and the Beneficiary are themselves responsible for keeping the Code safe.
- 11.2Loss, theft or unauthorised use of the Code is at the risk and expense of the Buyer and the Beneficiary. There is no right to compensation or replacement.
- 11.3If the Buyer asks the Entrepreneur to block the Gift Card and makes the purchase plausible, for example with proof of payment, the Entrepreneur will make reasonable efforts to block the Gift Card and, where possible, to replace it.
Article 12. Personal data
- 12.1The Entrepreneur uses the email addresses of the Buyer and the Beneficiary solely to send the Code.
- 12.2The email addresses, the Beneficiary’s name and the personal message are deleted as soon as the Gift Card has been created and, in the case of an incomplete payment, within twenty-four (24) hours.
- 12.3In all other respects the privacy policy of the Entrepreneur applies.
Article 13. Complaints
- 13.1Complaints about the performance of the Agreement must be submitted to the Entrepreneur by email, fully and clearly described, via newyinenyang@gmail.com.
- 13.2Complaints submitted to the Entrepreneur will be answered within a period of fourteen (14) days of receipt. If a complaint foreseeably requires a longer processing time, a confirmation of receipt will be sent within this period, with an indication of when the Buyer may expect a more detailed reply.
Article 14. Applicable law and disputes
- 14.1The Agreement and these general terms and conditions are governed exclusively by Dutch law.
- 14.2Mandatory provisions for the protection of the Buyer remain fully applicable.
- 14.3Disputes shall be submitted to the competent court.
